The Archers the Strata Professionals industry group said that the Queensland government's proposed amendments to residential tenancy laws could affect the well-being of the majority, but that they could be in vain given that the most rental properties are community title systems governed by corporations.
The Palaszczuk government is currently consulting with homeowners and the rental property sector throughout the state to evaluate the laws governing residential tenancy. The process should be completed by the end of November.
According to Mick de Brenni, Minister of Housing and Public Works, homeowners and tenants could more easily agree on keeping pets and on the issue of pet ownership.
However, Grant Mifsud, a professional partner of Archers the Strata, pointed out that the issue, along with other home modifications such as allowing real estate occupants to change window coverings, are often decided by a corporate committee and their stratifications by -laws.
"Corporations are like a fourth layer of government, except that it is the owners of the units and not the officials who make up the committee and take the majority of decisions," said Mifsud. "These decisions concern situations that affect people's living conditions. As a tenant or owner within a stratum property, it's important to be aware of what you can and can not do in your stratum schema. "
Mifsud also pointed out that some corporations have regulations called prohibitive regulations, which may prohibit tenants and owners from having animals in their properties. These laws may come without exception or prohibit all animals of a certain type, such as cats, dogs or dogs over 10 kg.
As such, the committee can not approve the keeping of an animal prohibited by the regulations.
Tenants may be required to ask the legal person for permission to keep an animal, to the extent that the by-laws and their tenancy agreement permit.
There is an option to challenge the decision and seek advice from an independent body that includes the applicable regulations, if an application is not approved.
Mifsud reiterated that it was essential to know the rules of the regime. Residents who violate regulations that do not apply to independent homes must be treated.
Pets, parking lots, parties, passive smoking, unsightly laundry hanging on the balcony and visitor behavior are usually the cause of the problem of strata.
